Legal Question in Civil Litigation in Pennsylvania

My fiance and I broke up. We have a home together with both names on the mortgage. He wants to keep the home, so how does that work? I paid the down payment and closing costs, he paid the mortgage the past two years, and I paid all the utilities.

I don't care that he wants to keep the home, but I want to make sure I do bot get ripped off in any way.

I assume that your name is on the deed & you are a co-owner. Since you signed the mortgage you are responsible that it is paid. If you transfer the property to your fiance you are still obligated on the loan until it gets paid in full, which is a bad thing since you will no longer be an owner of the property. If you don't care about being paid any money related to the home costs, the best way to handle this is for the fiance to obtain a new mortgage loan (very unlikely the current mortgage co will approve removing you from the current mortgage obligation) & then you transfer the home to him. The new loan will pay off the current mortgage, & you will have no more responsibility for the loan or the house. Good luck!
