Is there any way to re-file a case where the settlement left me worse off than when the case was originally filed? I had purchased a home where the title was defective. This was covered under my title policy and a closing protection letter but the title company refused to settle the claim. In court they intentionally misrepresented facts and supported the sellers in keeping an illegal claim on the title. I was poorly represented and eventually settled under financial duress. The statute of limitations has passed for a bad faith claim but I was wondering if there was another option. What they did was clearly illegal.
