Legal Question in Employment Law in Pennsylvania

Wrongful termination???

Can a company terminate an employee based on written statements from other employees stating that the employee used inappropriate language in front of customers when the employee in question states the exact phrasing of her statement, which included no profanity, to the terminating manager? The employee in question was told that the situation was 3 statements against her so the manager had to believe the written statements. The employee was also told that if the situation had been 1-on-1 the manager would have believed her side of the story.

Re: Wrongful termination???

As a general rule, if there is no written contract of employment then a private employer in Maryland can terminate an employee without cause. That means that as long as there is no discrmination based on race, sex, religion, etc., an employer can terminate an employee even if the termination is not "fair" to the employee.

There may be exceptions to this general rule. You may wish to consult with an attorney to explain more of the details and determine if any exception applies to your facts.
