The statute of limitations does not apply any more once a suit is filed. A party generally has two years from the date of the malpractice in which to sue, assuming that they realize that they have been harmed and that the doctor was the cause of that harm. The statute can be extended (its called the discovery rule) in certain cases. Yuo should speak with a medical malpractice attorney in your area. Don't go this alone.
