Legal Question in Medical Malpractice in Pennsylvania

I�m wondering if we have a malpractice case.

My daughter took my grandson to the doctor on 2/24/15 because he was having difficulty walking which is very unusual for him. The doctor told my daughter my grandson may be fighting off a cold and his equilibrium may be off due to the cold. My daughter asked the doctor what she she do with with her son since he's having this issue. The doctor never answered her. So she left there with no advise.

That night my grandson was still having difficulty walking, and threw up. My daughter kept asking me, "What should I do." I just told her I guess he has a cold like the doctor said so I told her to wait it out.

The next day he not could sit up, stand, walk, and was volmiting. My daughter asked me if she should call the doctor again. I said no, there's something really bad going on here so we took him to Childrens Hospital. He is still there and just started to walk a few steps on his own. His thinking has been effected to.

It has been so hard for us watching him suffer like this. He was diagnosed with having post infectous Cerebellitis.

Don't know if you have a malpractice case. Should the doctor have made the diagnosis on the first visit? A medical doctor would have to answer that question.

Would an earlier diagnosis have changed the treatment? What were the damages? Are they temporary or permanent?

Ask your current treating doctors their opinion.
