Legal Question in Military Law in Pennsylvania

Medical Discharge??

Am I going to be charged with fraudulent enlistment? I am going to request a medical review for discharge. I have all the documents supporting my case (i.e. dr's letter, all notes, snd physical symptoms still affecting ability even after my operation, ect...) But I have a problem, the symptoms were very subtle during the enlistment process and I submitted previous med. documents of my condition, yet the recruiter dissmissed the doc. without waiver. My condition was aggerveated during trainning and became worse. I am trying to find out if this is a fraudulent enlist? or should i go ahead with the med. dis. request???

Re: Medical Discharge??

There is no way for me to predict what the service will do with your request. If they think you fraudulently concealed a medical condition during the enlistment process, they may very well process you for separation under that provision. Medical documentation will be the basis for that determination, and often they get it wrong. You will not know until you try.
