Legal Question in Personal Injury in Pennsylvania

How long do insurance co. have untill they pay out on a auto claim.And if i were to take legal actions to retrieve my claim would they be pick up by the insurance co .or possibly the people at fault.

An insurance company has no obligation to pay anything to you unless you force them to pay. If they offer you money w/o you doing anything, you can be certain that they're not offering you enough! Hire a lawyer who is a personal injury specialist--after all fees and costs, you'll have much more money in your pocket than if you tried to do it w/o a specialist. Terence: Without more information, it is difficult to answer your questions. If I understand you first question, the insurance company has no time limit. The time limit is yours, not theirs. You have a 2 year statute of limitations to file suit if your case is not settled before then. If you do not bring you claim within that 2 year time frame, you forfeit your rights.

Any lawsuit is technically against the tortfeasor of the person that harmed you. However, we carry insurance to protect us against such claims. As a result, your claim, if applicable, would hopefully be paid by the insurance company. I caution you that every case is different and it is worth speaking to an attorney to make sure your rights are protected.
