Unhappy with Lawyer

I was a passenger in a car accident. I hired an local attorney who advertises on tv. I am completely unhappy with their service. I told him I wanted to get another lawyers opinion and he flipped out on me.

How can I switch attorneys?

The written agreement to provide legal services that your attorney provided should contain a provision concerning termination his services.

You have the right to terminate your lawyer at any time, no matter what language is in the fee agreement. You should consult with an experienced injury attorney you want to hire. Yes, you have the right to terminate your attorney. There should be a provision in your fee agreement with him. He may be entitled to a lien for any work he has done. I have several office locations, if you are interested in scheduling a free consultation.

Regardless of what the fee agreement says, all you have to do is write the lawyer a letter saying "I don't want you to be my lawyer any more", or words to that effect. If you want another lawyer to handle your case, if that lawyer is an experienced personal injury lawyer, that new lawyer will write the letter for you to sign. The new lawyer will have to work out something with the old lawyer to pay the old lawyer for his time spent--but that payment will be from lawyer to lawyer and shouldn't have any effect on how much money you eventually pay as a lawyer fee.

Dear Sir/Ma'am:

Sounds like the lawyer that you hired is a real toad. People like that give us a bad name...and that's a shame.

I have been practicing in Philadelphia for 10 years and am licensed in PA, NJ and FL.

The nice thing about switching lawyers is that you don't have to get involved with the transfer at all. I would write the necessary letters and get the file and instruct the other lawyer to have no contact with you whatsoever. If he didn't comply, then we'd file a bar complaint against him..it's as easy as that.

I'd welcome your call to discuss your case. Seems to me that if you were a passenger, then you may very well have a good case and should be treated with more respect and dignity.
