Legal Question in Real Estate Law in Pennsylvania

Condo Board & Vandalism Issues

I live in a PA Condo Assoc. My was vandalized (keyed & rear tires punched) 3 times in 1 mo. Car was in assigned parking space. I hooked-up video camera 2 VCR & attached 2 ''clip'' type floodlights to shine on car to better record (90 watt bulbs). No further vandalism since lights installed (lights shine down on car - not into neighbors homes). BOD doesn't like lights & agreed to install more lights on bldg, but type of fixture/bulb will not allow me to video tape clearly (must b able 2c rear of car). Not in violation of any condo governing docs with any of the above action. I indicated I would remove lights if BOD would assume liability for any future damages to car, which they refused. Can BOD fine or force me 2 remove floodlights? Is BOD liable for damages as a result of poor lighting in Common Area? Am I within my rights to protect my property?

Re: Condo Board & Vandalism Issues

It is difficult to advise you without reviewing the condo documents. The board has the right to control the use of the common areas. I am not sure what effect the assigned parking space will legally have unless more detailed information is provided. I suggest you consult with legal counsel and threaten legal action. Hopefully, this could force a resolution. If I can be of any assistence, please let me know. Gerald Hershenson Esq. 215-579-9390
