Legal Question in Real Estate Law in Pennsylvania

I have a friend who is out of state and has been renting a home here in Erie to people for approx. 2 years. They will not answer his calls and have been very late with the rent lately. He wants them out. Any suggestions on how he can most easily get them to leave?

He will have to go through a legal eviction in the county where the home is located. There are some lawyers who do lots of these on behalf of landlords, so it would probably be more economical and faster to find one of them.

THIS RESPONSE IS NOT LEGAL ADVICE, SINCE I DO NOT HAVE ALL OF THE INFORMATION THAT WOULD BE REQUIRED, AND I DO NOT HAVE A REPRESENTATION AGREEMENT WITH YOU.

* If the answers to your question confirm that you have a valid issue or worthwhile claim, your next step should almost always be to establish a dialog with a lawyer who can provide specific advice to you. Contact a lawyer in your county or township.

* Another reason for contacting a lawyer is that it is often impossible to give a good answer in the Internet Q&A format without having more information. The unique circumstances of your situation and things that you may not have thought to mention in your question may completely change the answer. If you want to be sure that you have a complete answer to your question and an understanding of what that answer means, establish a connection with a lawyer who practices in the area of your concern.

Pennsylvania has a specific Landlord/Tenant Act that addresses all such transactions. Residential leases are covered through the local Magistrate Court, which is essentially Pennsylvanias version of Small Claims Court. The blue pages in the phone book should provide a list of the Magistrate Judges in the County and often list which townships each Judge covers. Before a Complaint is filed, the landlord must comply with the terms and conditions set forth in the Lease and, if appropriate, a Notice to Quit may be required. The Landlord/Tenant Complaint form, for filing with the Court, is available on-line on the following website: http://www.courts.state.pa.us/Forms/Default.htm.
