Legal Question in Real Estate Law in Pennsylvania

Hello,

My wife and I closed on a house (in Pennsylvania) in the middle of September, 2015. Everything was free and clear with no liens on the home. In October, 2015 we were informed that a contractor had filed a mechanic's lien on our home. Again, I stress that this was after we closed on the home. Now, we are being sued for the enforcement of the lien. How is any of this possible? My wife and I had nothing to do with contractor, and our names on not on any contracts between the contractor and the previous owner. I do not understand how it is legally, morally or ethically possible for us to pay for a disagreement between two parties of which we are not involved. What can we do now? We are expecting our first child in June and would like to get this stress out of our lives.

Thank you very much.

If you have title insurance on your purchase, contact the title insurance company, which should have searched and, depending on how it insured your title, should have insured against mechanics' liens claims.

THIS RESPONSE IS NOT LEGAL ADVICE, SINCE I DO NOT HAVE ALL OF THE INFORMATION THAT WOULD BE REQUIRED, AND I DO NOT HAVE A REPRESENTATION AGREEMENT WITH YOU.

* If the answers to your question confirm that you have a valid issue or worthwhile claim, your next step should almost always be to establish a dialog with a lawyer who can provide specific advice to you. Contact a lawyer in your county or township.

* Another reason for contacting a lawyer is that it is often impossible to give a good answer in the Internet Q&A format without having more information. The unique circumstances of your situation and things that you may not have thought to mention in your question may completely change the answer. If you want to be sure that you have a complete answer to your question and an understanding of what that answer means, establish a connection with a lawyer who practices in the area of your concern.
