A defendant can file a Motion for an extension of time to file an Answer to the Complaint in Mortgage Foreclosure, but there is no guarantee that it will be granted. You are better off first asking the Plaintiff for an extension of time to file an Answer; the Plaintiff will usually agree to an extension of time to file your Answer. If the Plaintiff will not agree, then you can go to the Court by filing a "Motion for an Extension of Time to File Answer" and you would include in your Motion a statement that you requested an extension of time from the Plaintiff which request was refused and that is why you are now asking the Court for an extension of time.
