Tree from one lot falls on another lot, which lot owner is responsible for the cleanup?

Clearly you would think that would be the tree owner. However, there are other things to consider. What if the tree owner is a 90 year old widow sand your a 30 something year old with a chainsaw and a fireplace. Then again if the situation was reversed perhaps they'd be knocking at your door to get permission to clean up. Or maybe you want it for firewood. Then again how big was what fell in your yard.

First, talk to your neighbor. They'll be around longer than the tree limb. More often than not you two can work it out. Perhaps one of you has insurance that will pay to do the clean up. So talk to your neighbor the clean up will happen faster if you do.
