Family Estate

Sister is executor of mothers estate. My husband, her brother have not been on speaking terms since i took her to the magistrate after she acosted my daughter. There are five siblings which estate is to be divided evenly. A settlement from an asbestos case from deacesed father was granted.

Sister sent payment to all siblings except my husband.

Sent payment with note to our son, enjoy gift from grandfather. Is there any legel recourse that can be taken.

If all of the facts as you stated them are correct, your husband can bring an action against the executor of the estate. She does not have discretion to disburse the money as she feels appropriate. She has a fiduciary duty to all of the heirs of the estate, and must distribute according to the Will. You need to contact an attorney to assist you with this.
