Legal Question in Wills and Trusts in Pennsylvania

Wishes of Dad's

Dad died in 2004 and had no will. His wishes were for my brother to sale the house and the money be put in a trust for my sister with special needs, and said that if my sister should pass away, that the balance be devided among the remaining siblings.

My brother had to sale the house because his name was also on the loan but had nothing to do with the loan, but name only.

Here's the problem my brother sold the house and did not put it in a trust or will give us any information about this money.

My father told us that we all were beneficiaries of this trust.

My brother refuses to let anyone know what he's doing with this money or add us to the trust if any.

Can you tell me if there's anything that i can do about this.

Thank you very much.

Re: Wishes of Dad's

Without a will your father died intestate. So regardless of what he may have said it has no effect. However, the intestate statues are what apply. Under that based on what you said you are entitled to inherit. as is your sister and brother.

Did your brother ever get letters of administration? Even without a will whoever is going to take care of the estate needs to probate the estate. as part of the probate the administrator of the estate must provide the court with an accounting, detailing the expenses of the estate as well as the disposition of assets.

If you have any question feel free to contact me. the initial consultation is free.
