Legal Question in Criminal Law in Philippines
hi!my husband accuse for grave threat,but they dont have a evidence that it is grave threat.the municipal trial court still having this case even they know it is dismissable case.how can we make this case dismiss and thrown out in court?

You still have to present evidence to have it dismissed by the court. This is the procedure. Once the prosecution rested their case then your turn comes to present your testimonial evidence.
