You did not specify the particular case that you filed against your husband. However, if you are referring to a violation of the act punishing violence against women and their children or to Republic Act No. 9262 the relief of child custody may be granted together with the ex-parte issuance of a temporary protection order (TPO) on the date of the filing of the application pending issuance of the permanent protection order (PPO). This is very clear under Section 15 in relation to Section 8 (f) of RA 9262. This TPO/PPO is impliedly institued with criminal actions involving violence against women and their children.
