1 child, (soon to be 7 yrs old) never married, seoerate households. child support was based on the mother earning nothing, while she was in school studying to be an RN, against my salary and carrying full health and dental for the child. She is now an RN and working full time....Q: In the state of Rhode Island what is the proportionate formula for fair child support dispersement, I mean does what she earn & what i earn cancel one another out, and, if I hold the higher remaining earnings, is the remaining balance what the support would be based on?

In Rhode Island, child support is calculated based on a formula which takes into consideration the income of both parents, less costs for medical insurance, less support paid for other children. The calculation basically determines what standard of living the child would be enjoying if the parents lived together. Your earnings do not cancel one another out, but are added together to calculate the child support and the percentage of the total income that you make will be used to determine exactly what child support you are obligated to pay. Information needed to calculate child support is: gross income of both parties, cost of insurance for the child, and support paid for any other children.
