Aunt wants custody of Niece

My brother in lawand sister are going through a divorce. They live 2 1/2 hours away, but circumstances are not good for a child. It's complicated. My sister has had a boyfriend. I am married with no children and going to college 1 night a week. My husband is an lpn. Could we get custody? My niece needs to be loved and well cared for...She needs an adult that can be a mother to her and teach her things and spend time with her....

You may be able to get custody, but you did not provide enough information to answer with any degree of certainty. Your best chances of getting custody of this child would be if (a) both parents consent or (b) you could prove both parents to be unfit.
