Legal Question in Family Law in South Carolina

Divorce Time!!!!!!!

I moved out of my husbands house in the middle of July 2008. I was told that I could not file for divorce in SC for a year. My time is almost up. He says that there is nothing to fight about he just wants to be rid of me and I agree whole heartedly. When should I seek a lawyer? If the soonest I can file for divorce is Aug 2009, then I want my papers filed as soon as court opens on the first of Aug. Thank you in advance for your time.
