Legal Question in Family Law in South Carolina

Responsibility of Step-parent

My husband has custody of his 16 year old son. When we married, his son was 2 years old, and my husband was a painter. I raised the child for 10 years, in the interim I had a child who is Autistic, hearing impaired, and learning disabled. I had problems with the step son, and his mother let him go stay with her for 5 years, off and on. March of this year she sent him back to me. My husband is a paramedic now, and is away from home every 3rd day for 24 hours. I have asked the mother could her son stay with her on EMS days, she stated no, that he is my responsibility. Where do I stand? Thank you very much.

Re: Responsibility of Step-parent

You stand with your husband who has legal custody and legal responsibility for a 16 year old. Does the step-son's mother pay child support? If not why not? Does the mother live in your community?

Check with your attorney to see if there is a possibility of child support increase. It sounds like you may have had a change in financial or other circumstances.
