Legal custody needs to transferred through the Family Court. You can contact the Court or an Attorney regarding the process to do so.

The best way is to have the mother bring an action in Family Court to accomplish the transfer. If everyone agrees (including the father), then it should be fairly quick and relatively inexpensive.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
