Legal Question in Immigration Law in South Carolina

Got fined for (2494-Alcohol / Giving beer or wine to minor, transfer or gift, 1st Offense) and I pled guilt and paid fine.Recently when my leasing office did a background check on me for apartment renting. They notified me of such misdeamour. I am planning to apply for h1b in April 2015 and will this affect my chances of getting picked in lottery? Or will I have a problem coming back to USA if I leave the country. Is there anything that can be done to avoid this misdeamour showing up in my background check.

The visa petition itself won't be impacted by your criminal history. The change of status or your departure and attempted reentry could be impacted by the criminal history in total. You will want to discuss all of this with you attorney and your employer so that if issues arise, there are no surprises.

If you'd like to know the severity of the impact of your criminal history on your immigration status and would like a written opinion, please contact us to discuss that matter. As well, if your employer does not have counsel for the H-1B process, they can contact us as well to discuss that matter.
