getting my acre of land

my home is beaufort s.c.

my father died 20 years ago leaving 10 acres of land to his 12 children 2 who are dead,i want to take my land and build a home on it,but because my brother is in charge of the property and it has not yet been devided after asking so many times to cut my land off which he will not do,is there any way i can get my land without him?

If the property is located in Texas, then you can make a motion to the court requesting that the land be partitioned. You will probably need to do some minor title work on the parcel as well.
