Driving Under Suspension

I got pulled over in December 2008 because the police thought I was someone they were looking for and it was my 3rd time getting caught with DUS. So I served 60 days in jail. In February 2009, I get pulled again for having a tag light and that becomes my 4th offense. What should I do? I can not afford to do any more time. My family need me with them. I really do not believe I was suppose to serve time for the third offense, but I already did.

As a criminal defense here in South Carolina I can tell you that those are really hard charges to defend. Basically a defendant had a license or they didn't. Under the law, if you are convicted of a First or Second Offense, there is no mandatory jail time. However, with a Third or more offense, there IS mandatory jail time. Sometimes we can get a DUS Third or even a DUS Forth reduced to a second offense and let the defendant pay a fine just to keep them out of jail. Each case is different however and its hard to tell at this point how your's would pan out. The best thing you can do is to retain an attorney.
