Legal Question in Traffic Law in South Carolina

Insurance claim time limit

I was involved in a minor car accident in which the other party told me ''not to worry about it,'' failing to take my insurance policy number or other information. More than a month later I received a phone call and an estimate of damages. The party has failed to sucessfully contact me since and has left no return phone number. Six months later he wants compensation. Is there a statute of limitations on the amount of time in which you must make an insurance claim?

Re: Insurance claim time limit

Normally, the statute of limitations in this type of case would be three (3) years, assuming the accident happened in South Carolina. If you failed to report it to your insurance company at the time, the company may try to deny coverage on the accident, leaving you to have to pay out of your pocket.
