Legal Question in Criminal Law in Tennessee

Hello,

My name is Heather. I was on my way home from helping my sick grandfather and got pulled over in Robertson county last month for supposedly passing a car on a double yellow and I almost hit an officer head on. This is what really happened, I had a car that was riding my bumper for lime a mile and they went to pass me on a double yellow and I threw my hand up like what the heck and they got in front of me and slammed their brakes do I swerved to the other side of the road to avoid hitting them and when I tried to get back over they sped up and then next thing I know a white unmarked SUV is coming around a curve at me head on and they had to swerve into the grass. The officer came to my vehicle yelling at me and sent me into a panic attack and when I tried to tell him what happened he told me he didn't care and wouldn't let me finish so he wrote a ticket saying that I just passed the vehicle so I'm very nervous about what could happen and need advice on what to expect and what I should do or say

1 Answer from Attorneys

1 - If you have the means to hire an attorney, you may want to do so, or at least talk to an attorney before deciding what to do.

2 - If you can't afford an attorney, ask for one when you go to General Sessions court (the date shown on your citation).

3 - Tell your attorney the above, because there may be a dash board video camera to back up your side of the story. But dashboard camera information must be preserved as quickly as possible.

4 - Feel grateful you were merely issued a ticket, and not arrested and taken to jail. Improper passing is a minor offense, and generally carries only a small fine (no more than $50) plus court costs.
