Legal Question in Criminal Law in Tennessee

A week and a half after my fiancee's mother passed away, we received a call from a bank (not hers) stating they had a check there that was written on a closed account. Upon viewing the check, we noticed that it was not her handwriting nor was the DL # hers. We talked to the police and her bank yet they claim there is nothing they can do. We went to the D.A. and he says that the police have to bring him a case before he can prosecute so what can we do?

It is up to the police to investigate and prosecute crime.

The person who can speak for your finance's mother is the executor of her estate, but

even that would require that her estate suffered a loss. So unless the bank actually paid

money out of the deceased woman's account to a thief, there is no loss.
