Legal Question in Family Law in Tennessee

17 year old brother

My friend gained custody of his 17 year old brother in December of 2001. His mother had to get rid of him because of the trouble he was getting into in city housing. My friend took custody of him so his mother could stay in government housing. Since then his brother has had the law called on him for things he has done around the trailer park. His mother keeps saying she will take custody back but nothing has happened yet. They can not file an unrulely potition without paying child support and being charged with neglect. How do theyget rid of him? My friend has tried to help both his brother and mother out but nothing seems to work. And my friend and his five year old son is at risk of being kicked out of where they have lived for the past 5 years. Thank you.

Sorry. Your question does nto seem to make sense. If the adult brother has legal custody of the 17 year old the adult brother CAN file an unruly petition against the child and the adult brother need not be paying child support. Have the adult brother contact an attorney so all of the details can be properly addressed.
