Legal Question in Family Law in Tennessee

Child support enforcement & employer's order to withhold child support

A child support order was filed and an employer's order to withhold was sent. By mistake the employer sent the papers to the obligor. He has refused to give them to the employer to withhold payments from his check. He wants to pay them himself whenever he feels like it. What can I do since both he and him employer are in contempt of court.

Re: Child support enforcement & employer's order to withhold child support

Who made the mistake of sending the employer's documents to the obligor? If it was your lawyer, contact him and tell him to correct the mistake right away. If you did this yourself, contact the person who sent the documents to the wrong place. While the obligor may be in contempt, your inquiry doesn't incidate that the employer is in contempt because the employer doesn't have notice to deduct child support.
