Child taking Step-father's sir name

My daughter is 12. I was never married to the biological father and my daughter has my maiden name, like me. The biological father left when she was two, after protective order filed in Dallas court for physical violence against me. I am going to marry soon. I will be taking my husband's sir name. I have no clue as to the whereabouts of the biological father. I know he left the state when she was two. He has had no contact and pays no support. How do I change her name to match mine after the marriage?

If the court orders originated in a Texas court, you can file under the same cause number for a change of name for your child. You should retain an attorney, who will know how to accomplish the service of process.

You cannot just change her name. In TN a minor must have the consent of both parents. Once she is over 18...she can change it without either parent's consent.
