Do I or don't I ??

In my separation from my X he has not paid any child support. Do I need a lawyer to sue for back child support ?? Our divorce doesn't go to court till Feb and I can't wait that long to get support,, can I do something now?? I do not have a laywer,, do i need one?

Specifically what you need to do is file a Motion for Child Support pending the final divorce hearing. While it is not required that you have an attorney, that is like saying there is no requirement you use a dentist to fill a cavity. Call an attorney and get an Order requiring your husband to pay child support.

If you expect to get him to start doing anything different than what he is doing now with regard to support, you are going to need a lawyer. Further, if you just wait until February, when I assume his lawyer will be finalizing the divorce, you will have no control over what he and his lawyer put into the final order. It is not likely that the Court will adequately protect your rights and your child's rights, and your husband's attorney will definitely not be; its his job to protect your husband, not you.
