Legal Question in Family Law in Tennessee

Will I be Arrested?

I have joint custody of my 14 yr. old daughter, she has been abused by her dad and does not want to return to him. I have pics of the bruises he left. I have contacted child abuse(they have not seen the pics) but they can't help. If i refuse to give her back to her dad will I be arrested or will he just have to take me back to court? please help

Re: Will I be Arrested?

I don't know why DCS won't do anything. They should. But in the meantime, you need to go back to the court you got divorced in and file a petition or motion asking the Court to suspend his visitation privileges. If you have documented the abuse, the court should temporarily suspend his visitation pending an investigation. You can also go to your county's juvenile court clerk and ask them for the same thing. Some Counties will help you with that, others won't, so it depends on the county you're in. If you simply refuse him visitation without going to Court, you will get in trouble.
