Legal Question in Medical Leave in Tennessee

Numerous Family Medical Leaves

Can an employee have more than one FMLA? One for themselves and one for caring for a parent? Do the number of allowable days overlap, or does the employee have a total of 24 weeks of leave available? Please include verification material or references with response.

Need Clearer Information

I am not sure I understand your questions. However, I will state to you in general terms what is allowable in general under the Family & Medical Leave Act of 1993. I would definitely need more information from you because each person's situation is different. FMLA covers employers who employ 50 or more employees for each working day during 20 or more calendar work weeks, it doesn't have to be consecutive, in the current or preceding calendar year. Thus, you need to see if your employer is one that FMLA applies to. Then, you have to be eligible under the Act. An eligible employee would be one that have worked at least 12 months for the employer, must have worked at least 1,250 hrs during the preceding 12 months. If the FMLA applies & you are an eligible employee, then you can received up to 12 weeks of UNPAID leave time each year for the birth or adoption of a child, for a serious health problem of a spouse or immediate family memeber, or if you as the employee is not able to work due to your own health problems. 29 U.S.C. Sections 2601 et seq. & 29 C.F.R. Section 825.100 et seq.
