Legal Question in Civil Litigation in Tennessee

toxic exp/ hous law violations/breach of contracts

On behalf of the residents of the apts. I am living in

(will give name, when contacted), we wish to file a class action lawsuit against the management company of our apts. They were told in June 04,by a building inspector and a certified plumber, the apts had severe mold and structural damage. They did not fix it. They were told in July 05, the main sewer line had to be replaced, not just patched up. They refused & had it patched. They were aware the buildings werent up to building code violations, yet they continued to rent. Several floods, of water and sewage have occurred in and outside the apts. Residents have lost valuable items, they were told to file on their insurance, or given another apartment to move into. The mold is visible in several parts of the buildings. Residents have become ill with eczema, skin rashes, respiratory problems, coughing, wheezing, watery eyes, fever, extreme fatigue, migraines and dizziness. One resident is being screened for throat cancer, people have had to have sinus/respiratory surgeries. 3 children and 2 adults have experienced severe asthma attacks, one child was born prematurely, later suffered a seizure and quit breathing, had to be taken to hospital and stay

This is going to be a costly and protracted lawsuit. Do you have any funds to pay for an attorney to assist you with this lawsuit?

To proceed as a class action, each member of the class generally has to sustain the exact same injury. I am not sure if the various health ailments you describe would ultimately qualify as class injuries, or if courts would require each individual to file his own suit.
