Legal Question in Disability Law in Texas

PTSD - Fired for it

I Have been diagnosed woth chronic PTSD along with severe depression (recuring); Since my 1st diagnosis in February 2002 the Sheriffs Department gave an email which states that I could not return until i was ''emotionally'' for duty. At that time they gave me 6 month leave of absence then turminated me in December 2002.

I have not been able to find a job, i have been denied insurance and I am constantly visiting the VA Hospital in Houston for the disorders.

Have they violated the disability law?

It is possible that the ADA was violated. However, you have only 300 days from the date of the discriminatory conduct to file a Charge of Discrimination with the EEOC. If that did not occur, your rights will have passed and you have no right to pursue any claim against your former employer. There may be variations in Texas state law that will serve to extend this time. You need to consult in-person with an attorney as soon as possible to determine if your time has passed to file any actions against your former employer.
