Legal Question in Civil Rights Law in Texas

A girl bought my couch from me June 11, 2011 and I have held them for her for this long. We were never able to buy any more furniture till she picked up the couch. She moved out of state then all of a sudden wants to come pick up the couch. Can we legally charge storage fees? We can't afford to go without a couch or pay her they $500 she paid for them. She messaged me about every 3 months asking if they were still her's which I indicated yes but at this point she'd have to give up notice at this point before picking them up because we can't afford to up and buy more furniture and now she's threatening taking us to court.

Let me get this right - you took $500 for your couch and "sold" it to a girl.

You admit that you "sold" it.

Now you want to keep the money and the couch.

You cannot do both.

Either give her the couch or the money back.

Yes, she can take you to court.

She will win.

Then you will owe her court costs & the price of the couch.

If she hires an attorney, you will also owe her attorney's fees.

Storage fees for a couch a reasonable fee would be something like $50.

That won't buy a new couch.
