is it legal for en ex boyfriend to use a software to track my cell phone via GPS and also be able to read my texts, emails, see my pictures, and listen to my phone calls with this same software. i need to know so i can know if pressing charges would even hold up in court.

Based on only what you've told, it is not legal for him to do what he is doing. The legal name for it, in general, is "invastion of privacy," which is a civil remedy (in other words, you sue in civil court and try to win "damages" - legal name for money). To "press charges" against him, that is, to bring a criminal charge against him, you might file for "criminal tresspass." Much more information would have to be gathered, from you and other sources, before any sort of definitive, concrete answers could be given to you.
