Legal Question in Construction Law in Texas

I am A DBA. I did a finish out project, (interior) for a pharmacy, they do not own the property, they are leasing the space. They wont pay me for some extra things that I did as per there request, plus they still owe me from the original contract. They wnt the floor done over cause they dident like the one they chose, but they want me to pay for it, and I dont have any money, I am waitting for the rest of the ballance, they say they wont pay till the floor is done over. What can I do.

You will probably need to take them to small claims, if you qualify. I'd have to research how the lien might work under these facts.

Mr. Bormaster indicates that you have the right to file a lien affidavit against the property and, possibly, foreclose, even though they do not own the property. Depending upon when you completed the work, you may be in position to file an M&M Lien affidavit on the property and against the pharmacy. The owner of the property will make certain that the lien is cleared.
