Legal Question in Construction Law in Texas

We hired a local contractor in November of 2014 for concrete work at our home. He told us the job would take 5 days; a week at the very most. As of the end of March 2015 the work was still not completed and the portion he said is complete is not right and cracking. Part of the job was our patio which he has demolished twice and redone twice and is still not right and a mess. He has not returned any of our calls or emails. Clearly he has abandoned the job. I have a complete journal, phone records plus pictures. We need to hire someone else to finish the work. How long do we need to wait before hiring someone else to fix his work?

Dear Troubled: You need not wait any longer! Send your failed contractor a certified mail letter (Return Receipt Required), terminating his services, for cause, and based upon defective, unacceptable work.

Better yet, retain the services of an experienced construction attorney to do it for you, and to seek damages, etc.

Be certain to preserve evidence with photographs, videos, etc., all dated.
