Legal Question in Consumer Law in Texas

Pool Contractor Problem

I recently chose a company to do pool resurfacing at our home. He said that he would bring over a contract. We received no contract. Upon returning from work the next day we found that our pool had been drained. Work continued on the pool without a contract regardless of repeatedly requests.

On July 21st, I drafted a sample contract and faxed it to the owner's office. My cover letter stated that he could edit my document, but if he would sign the agreement, I would give him his down payment. He responded by calling & telling me he would not sign this contract, would not put in writing the terms, would take my contract to his attorney and charge me for the fees. I said I would not pay for his fees and he told me he was quiting was going to put a lien on my home, then came to my house, took his equipment and left. A day later we realized he had taken our only remaining & hard to find tile to repair the pool. Other than filing with the BBB, what do I do now...he stole our tile and has threatened this lien on my home. Thank you for any advice.

Re: Pool Contractor Problem

If he took something that didn't belong to him that is theft = file charges with the police or sheriff. Be prepared to contest the lien.
