Legal Question in Criminal Law in Texas

Enough evidence???

Cops pulled into gas station while we were getting gas (we are all 18 and under). Witness had seen someone jump out of our truck and smash a window on a car so called the cops. Cops found a hammer with glass shards and blood on it in back of truck. We all denied it so the cops said we would all be charged with destruction of property.

Question - is the ammount of evidence enough to really charge all four of us with the crime?

Re: Enough evidence???

An arrest requires probable cause, which is a fairly low burden. It would be necessary to review the court's file, however, the witness statements and the hammer are probably sufficient to establish probable cause for the arrest. Suficient evidence to establish guilt, however, may not be present. If you are in a Dallas metroplex county, I would be pleased to discuss your case. Most misdemeanor cases require a $500 down payment, with the total fee dependent upon the course of action taken in the case. Please feel free to contact me. TCL
