Legal Question in Criminal Law in Texas

Expungement

I want my criminal record expunged. In the yr. 2000 I was charged with an assault with a deadly weapon. I went to court and the judge dismissed the case. I do not remember the details of how this happened. I will not find out for another week. The case did not go before a jury. If I plead guilty, will it be impossible to expunge this felony charge from my record? If so, what can I do?

Re: Expungement

If the case was dismissed, then you should be able to expunged the case. However, if you plead guility and was put on deferred probation then you can't expunge the record.

Re: Expungement

If the judge dismissed your case, then you can get your case expunged from your record. However, if you plead guilty and the judge found you guilty and put you on probation you will not be able to have your record expunged nor will you be able to file a Petition for Non-Disclosure. If, on the other hand, you plead guilty or plead no contest and were placed on "Deferred Adjudication" then you may be able to file a Petition for Non-Disclosure to have the record sealed, but you should talk to good criminal attorney in your area. Good Luck.
