Legal Question in Criminal Law in Texas

How do I file a Writ of Habeas Corpus?

My husbands appeal was affirmed in the 1st court of appeals, and we would like to go to the next step. We would like to know if we should next file a Writ of Habeas Corpus, and how? Do we need an attorney to do so? Can we get an attorney to do this Probono? Is there a cost for filing this?

Re: How do I file a Writ of Habeas Corpus?

First you need to find out if you are still within the time to file a petition for discretionary review.

This is an appeal to the Court of Criminal Appeals in Austin, Texas.

After that you need to look into a writ.

But be very careful because you only have one shot at a writ and if you mess it up you don't get another chance.
