Legal Question in Criminal Law in Texas

Grand Jury No Bill Vote

My 19 year old son was assaulted by 39 year old male which left him blind in one eye and stands to lose the eye altogether. The grand jury unexplicably no billed even though evidence was overwhelming in favor of true bill. D.A. will not present case anew unless we (not him) can come up with new evidence even though we can never know what evidence was reviewed by the grand jury. What can we do to get this or another grand jury to review the case again? Any reference cases? Any writs?

Re: Grand Jury No Bill Vote

Sounds to me like you need to elect a new DA. They're supposed to represent the public and do their best. He can represent the same evidence to as many grand juries as he feels like until one of them says "yes." Sounds to me like he's incompetent or lazy if you're right about the facts of the case, or else you've missed something that shows a serious problem in your son's case. You could try to sue the perpetrator and see what you can subpoena from the proceedings of the grand jury and/or the DA, though you may not succeed with that, but it could be worth a try.
