Legal Question in Criminal Law in Texas

My husband and I have been charged with A Class B Misdameanor Theft 50-500. We are not guilty of this. We had a bad situation with and exlandord whom we were on a lease to purchase contract with. We realized last year that we were really being screwed out of our money when we we received an itemized list of our balance of for the home. After paying over $30,000 for a home that was worth $45,000 they wanted us to pay a total of $150,000. We decided we had spent enough money on this house and trying to get it in living condition to continue to stay. We notified the landlord that we were leaving and would not continue to pay anymore money. He was angry and stated we would pay for this. A year later my husband is arrested without any contact or notice from anyone for theft of a washer and dryer that had been left in the home. We were forced to move from this house in 1 day due to being harrased by the landlords boyfriend and have many witnesses that woult attest to the fact that we NEVER removed any appliances from the home. We were told that the landlord was doing this for insurance purposes and had to point the finger at someone to finish the house which was a mess to begin with. My husband is a correctional officer with the state and had been put on Administrative Leave and I work for a Law Firm. Neither one of us have ever been in any trouble not even a traffic ticket. We need to know our options and have this dismissed. What are our chances.

You will both have to hire lawyers and go to court. The lawyer will want to interview any witnesses that you have - especially those who helped you move and especially those who were there for the last load. The case may be able to be dismissed but you know that the complainant wants it prosecuted so your lawyer will have to present evidence to justify a dismissal. If no dismissal, then you both need to plan to go to trial and put the State to proving the case. Your reputations alone will help.
