Legal Question in Criminal Law in Texas

My neibor had an affair with my husband. I want to know can I get in trouble for putting a sign on my car stating "whore" with an arrow pointing in the general direction of her home?

That would probably fall under the misdemeanor harassment statute.

I suggest you consider filing a lawsuit for alienation of affection. Then see if you can serve her by publication. Contact an attorney.

There probably is not a crime that this fits under and, if there were, it would have serious free speech implications.

Think about what you want to do. Is this really the best response. If you end up with either of you filing for a divorce, then his bad acts will be able to be taken into consideration; do you want the judge to think that you are equally bad? Besides, revenge is a very fleeting emotion and most people usually regret it later. Don't do anything without talking to an attorney.

Alienation of affection was abolished in Texas years ago. You cannot sue her for these actions. In a divorce, though, you might be able to recover for money that he spent on her. Discuss this with your attorney.

Also, you know where she lives, so you cannot serve her by publication.
