Legal Question in Criminal Law in Texas

Statute of Limitations Bad Check

I just received a post card stating I have a bad check in Kaufman County. This check had to have been written in 1996. I have always had an updated DL# and filed my taxes each year with current address. I want to pay any debt I owe. But, I am concerned that I could face criminal charges. Has the statute of limitations run out on the ''bad check''. I got this card in the mail yesterday and I would like to be prepared when I speak with the District Attorney tomorrow. It has been almost 14 years since this apparently happened.

Re: Statute of Limitations Bad Check

It depends on when charges were filed. The state would have 2 years to file charges from the date of offense. If they filed charges within that time, then they do not have a limitations problem. They might have a due diligence problem though.

Either way, DA will most likely be willing to dismiss charges with full restitution on the check.
