What are the stutatory rape laws in Texas

my girlfriend and i got caught having sex im 16 shes 15. her dad shoved by me to get in my house and then assaulted me. i just want to know what can be done in either case, so that i know what can be done to me and what i can do to him. anything is appreciated.

The statutory rape laws may not even apply to you in the first place, as you are also a minor. Even if they do apply, a defense to prosecution is that you are no more than three years older than the girl, which would apply in your case. The father of your girlfriend has committed an assault and can be punished either criminally or through civil court (i.e. you sue him). As you are a minor, you cannot sue him by yourself--you need your parents to sue on your behalf. Please feel free to contact me if you have any further questions.
