Legal Question in Criminal Law in Texas

Texas photography laws as of 9/1/01

A friend of mine takes pictures of womens behinds for a web site. This web site contains no nudity and no women under the age of 18. The site only has pictures of their behinds, no faces or other ways of indentification. My friend was recently arrested at a very public place for taking these pictures. I want to know the law for taking pictures of people who do not know you are taking their picture, if they are holding my friend legally, and the possible punishments for this act. The charge for the act is called Inproper picture taking. Thank you very much!

This question sounds like a joke. The law on picture taking has always been (because we're a free country, remember?) that if you are where you legally can be, then you are free to record the images you could perceive with your own eyes at the same location. Unless there is some strange city ordinance where your friend was, I can't imagine this being any real charge. If there is such an ordinance, I doubt it could withstand a constitutional challenge.
